Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Do not enter this Sweepstakes if you are not, at the time of entry age 18 or older. Sweepstakes begins at approximately 8:00a.m. (EST) on June 29, 2012 and ends at 11:59 p.m. (EST) on August 31, 2012.

How to Enter the Sweepstakes:

Connect to SpaFinder’s World Wide Web page at http://www.spafinder.com and click on the Readers’ Choice link located at http://www.spafinder.com/rca/2012.htm. Vote in any or all of nine (9) separate voting classes: (1) Crystal Award, (2) North America, (3) South America, (4) Europe, (5) Asia, (6) Australia, (7) Africa, (8) Category, and (9) Local Awards. For each voting class in which you cast any votes you will receive one (1) entry into the Sweepstakes, for a maximum of nine (9) entries. Entries are due by 11:59 pm (EST) on August 31, 2012. No mechanically reproduced entries will be accepted.

Participants must provide a valid e-mail address. Sponsor is not responsible for computer system, phone line, hardware, software, or program malfunctions or other errors, failures, or delayed computer transmissions or network connections that are human or technical in nature. Sponsor is also not responsible for incorrect or inaccurate entry of information, whether caused by Internet users, or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of the entries in the Sweepstakes. In addition, Sponsor is not responsible for failed, incomplete, garbled, misdirected, or misrouted electronic communications, whether caused by the sender or by any of the equipment associated with or utilized in this Sweepstakes. In the event of a dispute regarding the individual who actually submitted an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered.

All requested information must be completed to enter. No purchase is necessary to claim prize. Limit one entry per person for each of the nine (9) voting classes. If you vote in each class you will receive nine (9) entries in the Sweepstakes. By entering, all participants agree to be bound by the official rules of these Sweepstakes. This Sweepstakes is open only to individuals who, at the time of entry, are age 18 and older. Employees, officers, directors, and shareholders of SpaFinder, Inc., and its parent companies, subsidiaries, affiliates, retailers, sales representatives, distributors, and advertising and promotion agencies, as well as the immediate family members and/or persons living in the same households of each, are not eligible for this Sweepstakes.

Owners, employees, their immediate family members and/or persons living in the same households of each, and other representatives, of any property or other nominee are not eligible for this Sweepstakes and may not submit a survey. Violations of this prohibition will result in the property/nominee being disqualified from the voting and rendered ineligible to win a Readers’ Choice Award.

This Sweepstakes is void where prohibited.

Drawing:

Winners will be selected in a random drawing conducted on approximately September 10, 2012 from among all eligible entries received. Judges’ decisions are final and binding in all matters relating to the Sweepstakes. ODDS OF WINNING ARE BASED UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. Winner will be notified by e-mail.

Prizes:

One (1) Grand Prize winner will have his/her choice of one of four different vacation packages—winner may choose one of the following:

Package #1

4 night vacation package for two (2) persons to Montage, Laguna Beach, California. Package includes: deluxe double accommodations; $50 daily breakfast credit at The Loft or in-room dining; two (2) lunches during the stay at Mosaic Bar Y Grille for 2 persons ($100 value per lunch); one (1) dinner at The Loft for 2 persons ($200 value); a total of two (2) 60-minute facials during the stay; a total of two (2) 60-minute massages during the stay; access to fitness facilities; complimentary wellness classes daily. Room tax included, gratuities are not included. Transportation to and from Laguna Beach, California is not included and is the winner’s responsibility; round-trip private sedan transfer between John Wayne Airport, Orange County, California and Montage is included. Alcohol is not included. All additional spa services, additional meals, and all other expenses not specified herein are not included in the prize package and are the winner’s responsibility. Prize package reservations subject to availability and validity, you must check with the property. Not available during July and August, holiday weekends or other special events period. Prize package expires September 30, 2013. Prize package is non-transferable, may not be extended beyond the validity dates, and retains no cash value. Guest accompanying winner must sign and return release of liability and publicity prior to travel. If winner’s guest is a minor, he/she must be accompanied by a parent or legal guardian (at winner’s expense) who must sign and return all required documentation. Prize package is not refundable or changeable. All items must be used during initial visit.

Package #2

7 night vacation package for two (2) persons to Spa Eastman, Eastman, Canada. Package includes: double accommodations in spacious room with fireplace; three (3) meals daily per person (including non-alcoholic beverages); a 30-minute welcome with a wellness coach and Trio Kine for one person which includes: evaluation of physical condition (60-minutes), building a training program (60-minutes), and private training (60-minutes); access to fitness facilities. Transportation to and from Spa Eastman is not included and is the winner’s responsibility. Alcohol is not included. Taxes and gratuities are not included. All spa services, additional meals, and all other expenses not specified herein are not included in the prize package and are the winner’s responsibility. Prize package reservations subject to availability and validity, you must check with the property. Prize package expires September 30, 2013. Prize package is non-transferable, may not be extended beyond the validity dates, and retains no cash value. Package #3

3 day/2 night vacation package for two (2) persons to The Peninsula, Bangkok. Package includes: deluxe double accommodations; breakfast daily; one (1) 50-minute spa treatment per person during the stay; access to fitness centre. Tax and gratuities are not included. Transportation to and from Bangkok is not included and is the winner’s responsibility; roundtrip transfer from local airport to The Peninsula is included. All additional meals, all additional spa services, all beverages, and all other expenses not specified herein are not included in the prize package and are the winner’s responsibility. Prize package reservations subject to availability and validity, you must check with the property. Not available on holidays. Prize package expires September 30, 2013. Prize package is non-transferable, may not be extended beyond the validity dates, and retains no cash value. Guest accompanying winner must sign and return release of liability and publicity prior to travel. If winner’s guest is a minor, he/she must be accompanied by a parent or legal guardian (at winner’s expense) who must sign and return all required documentation. Package #4

4 night vacation package for two (2) persons to LaSource, St. George’s, Grenada. Package includes: luxury double accommodations; all meals and beverages (including alcohol); two (2) spa treatments per person during the stay; access to fitness facilities; non-motorized water sports; 9 hole executive par 3 golf course; holistic classes; TA’I CHI; meditation; yoga; snorkeling; ocean kayaking; windsurfing; Hobie Cat sailing; sailing and wake and knee boarding; aqua aerobics classes and water volleyball. Tax and gratuities included. Transportation to and from St. George’s, Grenada is not included and is the winner’s responsibility. All additional spa services, and all other expenses not specified herein are not included in the prize package and are the winner’s responsibility. Prize package reservations subject to availability and validity, you must check with the property. Not available on holidays. Prize package expires September 30, 2013. Prize package is non-transferable, may not be extended beyond the validity dates, and retains no cash value. Guest accompanying winner must be 16 years or older and must sign and return release of liability and publicity prior to travel. Prize package is not refundable or changeable. All items must be used during initial visit.

Approximate retail value of Package #4 is US$2,800.

Winner may choose either Package #1 or Package #2 or Prize Package #3 or Prize Package #4.

General:

All taxes and any other fees or costs associated with any of the Grand Prize prize packages not identified above are the sole responsibility of the winner. The Grand Prize is nontransferable and no substitutions or cash redemptions will be made, except as provided herein. In the event any of the Grand Prize prize packages become unavailable, Sponsor reserves the right to award a prize of equal or greater value. The winner will be required to sign and return an affidavit of eligibility and a liability and publicity release within 5 calendar days of the date when such documents are sent to winner, or prize will be forfeited and awarded to an alternate winner. The Grand Prize will be awarded to verified winner. By entering the Sweepstakes, participants agree to release SpaFinder, Inc., and its parent companies, subsidiaries, affiliates, retailers, sales representatives, distributors, advertising, and promotion agencies, as well as its and each of their respective directors, officers, employees, and shareholders, from any and all liability, loss, damage, or injuries of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession, and/or use or misuse of any prize, or for any typographical or other error in the printing, offering, or announcement of any prize. Participants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee expressed or implied, in fact or in law, relative to any prize, including, but not limited to, its quality or fitness for a particular purpose. By accepting the prize, the winner agrees to the use of his/her name, likeness, voice, and/or biographical information by Sponsor, or any party authorized by Sponsor, for advertising and promotional purposes, without additional compensation, except where prohibited by law. Entries become the property of the Sponsor and will not be returned. In the event of noncompliance with the official rules, if a winner cannot be reached at the e-mail address in winner’s entry form within 5 calendar days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, the particular prize will be forfeited and an alternate winner will be selected.

Sponsor is not responsible for any damage to a participant’s system that is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the promotion. Any dispute or claim arising out of the play of this Sweepstakes, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of New York, without respect to conflicts of laws principles. Any such claim shall be brought and maintained in the federal or state courts of the State of New York. If any provisions of these official rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. Sponsor assumes no responsibility for any error, omission, interruption, deletion, theft, or destruction, or unauthorized access to, or alteration of, entries. Entries that have been tampered with are void. Sponsor reserves the right to disqualify any participant who Sponsor determines, in its sole discretion, has threatened the operation of this Sweepstakes or website, or violates these official rules. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should viruses, bugs, or other causes beyond Sponsor’s control corrupt the administration, security, or proper play of this Sweepstakes. All federal, state, and local laws apply.
