Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. This Sweepstakes is intended for viewing and participation in the 50 United States and the District of Columbia ("U.S.") only and shall only be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not, at the time of entry (i) a legal U.S. resident located in the U.S., and (ii) age 18 or older. Sweepstakes begins at approximately 12:00 p.m. (EST) on October 10, 2007 and ends at 11:59 p.m. (EST) on November 3, 2007 (the "Promotion Period").
How to Enter the Sweepstakes:
(i) Connect to SpaFinder's World Wide Web page at www.spafinder.com/select/thespaexperience/ and enter the Sweepstakes by filling out the entry form with your e'mail address and full name. After you complete the entry form, press "submit" and you will be entered into the Sweepstakes, or (ii) complete the official entry form available at SpaFinder's The Spa Experience at The Vanderbilt Hall at Grand Central Terminal in New York City from October 31, 2007'November 3, 2007. All entries are due by 11:59 pm (EST) on November 3, 2007. No mechanically reproduced entries will be accepted.
Participants must provide a valid e'mail address. Sponsor is not responsible for computer system, phone line, hardware, software, or program malfunctions or other errors, failures, or delayed computer transmissions or network connections that are human or technical in nature. Sponsor is also not responsible for incorrect or inaccurate entry of information, whether caused by Internet users, or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of the entries in the Sweepstakes. In addition, Sponsor is not responsible for failed, incomplete, garbled, misdirected, or misrouted electronic communications, whether caused by the sender or by any of the equipment associated with or utilized in this Sweepstakes. In the event of a dispute regarding the individual who actually submitted an entry, the entry will be deemed submitted by the person in whose name the e'mail account is registered.
All requested information must be completed to enter. No purchase is necessary to claim prize. Limit one entry per person or e'mail address, two per family or household. By entering, all participants agree to be bound by the official rules of these Sweepstakes. For a copy of the official rules, send a self'addressed stamped envelope to SpaFinder, Inc. This Sweepstakes is open only to individuals who, at the time of entry, are (i) legal U.S. residents located in the U.S., and (ii) age 18 and older. Employees, officers, directors, and shareholders of Sponsor, JetBlue Airways Corporation ("JetBlue"), Stoweflake Mountain Resort & Spa, and their respective parent companies, subsidiaries, affiliates, retailers, sales representatives, distributors, and advertising and promotion agencies, as well as the immediate family members and/or persons living in the same households of each, are not eligible for this Sweepstakes. This Sweepstakes is void where prohibited.
Drawing:
Winner will be selected in a random drawing conducted on or about November 10, 2007 from among all eligible entries received. Judges' decisions are final and binding in all matters relating to the Sweepstakes. ODDS OF WINNING ARE BASED UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. Winner will be notified by e'mail.
Prizes:
The following prizes will be awarded:
One (1) Grand Prize: Two (2) roundtrip JetBlue Travel Certificates (together, "Travel Certificates") good for travel for Winner and one (1) guest from the city served by JetBlue nearest to the Winner's residence to any other city served by JetBlue; Luxury room accommodations at Stoweflake Mountain Resort & Spa in Burlington, VT for three (3) nights; One (1) spa treatment person per day at the award winning Spa at Stoweflake (total 3 per person); Breakfast daily at Charlie B's restaurant; Dinner nightly at the AAA 4'diamond Winfield's Bistro; more than 50 complimentary fitness classes to choose from daily; and full use of the spa complex. Room tax is included, gratuities are not included. Alcohol is not included. Prize travel must be completed within one year of awarding and Grand Prize winner must provide at least 45 days advanced notice prior to intended date of departure. Grand Prize winner is solely responsible for all other expenses not specified herein, including but not limited to ground transportation, meals, beverages, gratuities, taxes and hotel incidentals. Accommodation restrictions and blackout dates may apply. All travel dates and arrangements are subject to change, availability and Sponsor's approval. Sponsor and JetBlue are not liable for any expenses incurred as a consequence of flight cancellation/delay. Certain documentation and requirements may be necessary for travel, such as photo identification, passport, or visa. Grand Prize winner and guest are solely responsible for obtaining any necessary documentation and fulfilling any necessary travel requirements prior to travel. In addition, the Grand Prize winner may be required to present a valid credit card at the hotel at the time of check'in. No substitution or transfer of prize except with Sponsor's permission or where required by law. Prizes may not be redeemed for cash and may not be sold or bartered, including in any transaction on EBay or similar auction websites. Sponsor in its sole discretion may award a substitute prize of equal or greater value if advertised prize is unavailable at time of awarding. Prizes will only be delivered to address within the United States. Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive a 1099 tax form reflecting actual value of any prize valued at $600 or more. Odds of winning any prize depends on total number of eligible entries received during the Promotion Period. In the event that Winner elects for any reason not to use the airfare component of the prize, airfare component will be forfeited, and JetBlue will provide no compensation or substitution for difference in prize value. Winner and guest must travel together on the same itinerary and flights, as determined by JetBlue. Certain restrictions and blackout dates may apply, all of which are subject to change at the sole discretion of JetBlue. Travel may be capacity controlled and space is limited. Use of Travel Certificate(s) is subject to additional terms and conditions. Schedules subject to change without notice. JetBlue reserves the right to deny boarding to passengers without the proper documentation. Other restrictions apply. Redeemed travel is not eligible for TrueBlue points and may not be used toward the purchase of a JetBlue Getaways Vacation Package or JetBlue Cruise. Passengers using Travel Certificates are subject and entitled to all provisions of JetBlue's Contract of Carriage, except those provisions regarding denied boarding compensation and the JetBlue Customer Bill or Rights.
Approximate retail value of Travel Certificates is $598.00; actual value may vary depending on winner's departure city and date of travel. Approximate retail value of Stoweflake Mountain Resort & Spa package is $2,000.
Approximate retail value of Grand Prize is $2,598. (Actual final value of trip may be higher or lower based on point of departure and ticket and hotel availability and cost at time of purchase.)
Conditions and Limitations of Liability: By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsors and Sweepstakes Administrator, which shall be final in all respects. By participating in this Sweepstakes, entrants agree to indemnify, defend, and hold harmless Sponsor, JetBlue, Stoweflake Mountain Resort & Spa their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injuries, losses, damages, obligations, costs, fees, expenses, actions, causes of action and liabilities of any kind or nature whatsoever (including reasonable attorneys' fees and disbursements) arising in any manner, directly or indirectly, from participation in this Sweepstakes, these Official Rules, entrant's entry, the acceptance or use or misuse of any prize, any travel, any personal injuries, any death, or any property damage. Further, by submitting an entry or accepting any prize, all entrants agree to forever waive, release, discharge and covenant not to sue the Sponsor or Released Parties, of, for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of action whatsoever, of every nature, character and description, known and unknown, including, but not limited to, all those arising out of or in any way related to the Sweepstakes, these Official Rules, entrant's entry, the acceptance or use or misuse of any prize, entrant's information, any travel, any personal injuries, any death, or any property damage. By submitting an entry, entrant represents and warrants that he or she owns and/or has the authority to release the claims stated herein. By entering, entrants also authorize the Released Parties to use their name, voice, likeness, photograph, prize information, biographical data and city and state of residence in programming, advertising and/or promotional material or on a winner's list (if applicable) without further compensation to the extent permitted by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. Sweepstakes subject to the laws of the United States only. All federal, state and local laws and regulations apply. All submissions become the property of Sponsors and will not be acknowledged.
THE PRIZES ARE PROVIDED "AS IS," AND SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
The winner will be required to sign and return an affidavit of eligibility and a liability and publicity release within 5 calendar days of the date when such documents are sent to winner, or prize will be forfeited and awarded to an alternate winner. In the event of noncompliance with the official rules, if a winner cannot be reached at the e'mail address in winner's entry form within 5 calendar days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, the particular prize will be forfeited and an alternate winner will be selected.
Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action. Any and all claims, judgments and awards shall be limited to actual out'of'pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees. Under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out'of'pocket expenses.
Sponsor is not responsible for any damage to a participant's system that is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, theft, or destruction, or unauthorized access to, or alteration of, entries. Entries that have been tampered with are void. Sponsor reserves the right to disqualify any participant who Sponsor determines, in its sole discretion, has threatened the operation of this Sweepstakes or website, or violates these official rules. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should viruses, bugs, or other causes beyond Sponsor's control corrupt the administration, security, or proper play of this Sweepstakes. All federal, state, and local laws apply.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York without giving reference to its conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Sweepstakes or relating to these rules shall be instituted only in the federal or state courts located in the State of New York, County of New York, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The parties agree to waive any defense of forum non conveniens or improper venue. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
